By using our website, mobile application, or services (collectively, the “Services”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read them carefully.

1. Acceptance of Terms

1.1 By accessing or using Speshall, you confirm that: • You are at least 18 years old. • You agree to comply with all applicable laws and these Terms. • You accept responsibility for all activity conducted under your account. If you do not agree, you must not use the Services.

2. Account Registration

2.1 Customers and drivers must register an account to use Speshall. • You agree to provide accurate, complete, and up-to-date information during registration. • You are responsible for maintaining the confidentiality of your account login credentials. • Speshall reserves the right to suspend or terminate accounts if false information is provided or Terms are violated.

3. Services

3.1 Speshall provides an online platform connecting riders with independent drivers for transportation services. • Speshall acts as a technology provider and is not a transportation company or a party to the ride agreement between riders and drivers. • All rides are subject to availability, and Speshall cannot guarantee driver assignment in all cases.

4. Booking and Payments

4.1 Customers must provide accurate pick-up and drop-off locations. • Fares are calculated based on distance, time, traffic, and any applicable fees or surcharges. • Payment can be made via cash, card, or in-app wallet. • Drivers receive cash directly from riders, and the app records total fare and any tips.

5. Cancellation Policy

5.1 Customer cancellations: Free cancellation is allowed if the driver has not started traveling to the pick-up location. • Cancellation fees may apply if the driver is en route. 5.2 Driver cancellations: Drivers may cancel trips for valid reasons, including safety, traffic, or vehicle issues. • Drivers must provide a reason for cancellation through the app.

6. Rider and Driver Responsibilities

6.1 Riders: Provide accurate information and follow local laws. • Treat drivers with respect and follow safety guidelines. • Report any issues promptly through the app. 6.2 Drivers: Maintain a valid driver’s license, ID, and registered vehicle. • Ensure vehicles are clean, safe, and functional. • Follow traffic laws and prioritize rider safety. • Report incidents or unsafe situations immediately through the app.

7. Ratings and Feedback

7.1 Both riders and drivers can rate each other after trips. • Ratings are used to improve service quality, determine driver incentives, and address complaints. • Abusive or fraudulent ratings may result in account suspension.

8. Safety and Security

8.1 Speshall prioritizes safety for all users. • Real-time ride tracking, emergency assistance, and reporting features are available in the app. • Speshall is not responsible for accidents, personal injury, or loss incurred during a ride, but we will assist in resolving issues reported through official channels.

9. Privacy

9.1 Use of Speshall is governed by our Privacy Policy, which details how personal and location information is collected, used and protected.

10. Prohibited Conduct

10.1 Users agree not to: • Use the platform for illegal purposes. • Harass or threaten other users. • Provide false information or manipulate fares. • Tamper with the app or interfere with its operation.

11. Intellectual Property

11.1 All content, branding, logos, and software in the Speshall platform are the property of Speshall or its licensors. • Users may not reproduce, distribute, or create derivative works without prior written consent.

12. Dispute Resolution

12.1 Users should first attempt to resolve disputes through the app’s Support feature. • Any unresolved disputes may be escalated to arbitration or courts in accordance with applicable law in Botswana.

13. Limitation of Liability

13.1 Speshall is not liable for direct, indirect, or consequential damages arising from the use of the platform or services. • The platform merely facilitates connection between riders and drivers; Speshall is not responsible for the actions of individual drivers or riders.

14. Changes to Terms

14.1 Speshall may update these Terms from time to time. • Updates will be communicated via the app or website. • Continued use of the Services after updates constitutes acceptance of the new Terms.
